In June 2023, the Foreign Subsidies Regulation (‘FSR’) came into force. Since then, there has been one phase II conditional clearance decision by the European Commission in relation to a notification of a concentration and the threshold of 1,000 notifications has been passed for public procurement notifications.
The ex-officio tool has also been used by the European Commission to request information from a large number of businesses, which has already been met with an ongoing challenge in front of the EU courts.
In addition, the Commission published last week a Call for Evidence to inform the elaboration of the guidelines on certain key concepts of the FSR, which will need to be adopted by 13 January 2026. Stakeholders have until 2 April 2025 to submit their comments.
